AUTOMOBILE/PEDESTRIAN ACCIDENT:  Plaintiff claimed that the defendant ran over her foot. Plaintiff, 35, waitress, suffered crush fractures of her foot with nerve damage. DR. RON WAGNER, $1,500.00 testified plaintiff has a 5% disability. Defense Doctor, DR. JEFF PENNER, testified plaintiff has no disability.

Plaintiff's medical bills were approximately $4,000.00. Plaintiff claimed $10,000.00 in lost wages. An Offer of Judgement was filed in the amount of $15,001.00. The jury found no permanent injury but awarded past medical expenses of $3,980.00.
